Terms & Conditions of Hire:
(1) Road Usage:

- New Zealand law requires the bike rider to wear a cycle helmet when riding and to use lights when appropriate.
- You agree that you have a good understanding of New Zealand and / or international Road Code rules and will keep left on the road at all times, observe all Road Code rules and use cycle lanes/paths when I can, while being careful and respectful of other users.
(2) Equipment and Riders Responsibilities:
- Riding Restrictions
You will NOT ride or park the e-bike on the beach, nor ride in the sea, waterways or rivers (rain is acceptable). - Island Use Only
You will NOT take any bike or equipment off Waiheke Island. - Night Riding
No riding after dark without lights. - Private Land
No riding on private land or vineyards unless permitted. - Helmet Requirement
Helmets must be worn at all times while riding as required by New Zealand law. - Safety Instructions
Riders must follow all safety instructions and guidance provided by eRide Waiheke staff. Failure to follow instructions may be considered negligent behaviour and may affect liability for injury, damage or loss. - Care of Equipment
You will respect the equipment and treat it like your own. If you experience an issue or problem, you must let us know immediately so we can support you. Failure to notify us during the ride is not an excuse. - Damage or Loss
You will report any damage immediately and understand that you are liable for any damage, theft or loss of bikes and/or equipment, including excessive wear caused by negligence or misuse of equipment. - Locking the Bike
The e-bike must be securely locked whenever it is unattended using the lock provided. Failure to secure the bike may be considered negligence and the rider may be liable for theft or loss of the bike and equipment. - Return and Late Fees
I agree to return the e-bike by the agreed-upon time of 5.30pm. Late returns may incur a charge of up to $100 per hour or part thereof to cover operational disruption, staff time and recovery costs until the bike is returned to eRide Waiheke.
The e-bike and accessories are for my use only and must not be lent to others. - Support During Ride
During your ride we support you and the e-bike. You must notify us immediately if you are experincing any issue so we can assist. Please do not attempt to repair the e-bike yourself or keep riding with any issues.

We prioritise adherence to health and safety protocols. If you are not confident riding or feel unwell, please contact us and we can arrange to collect the e-bike (fees may apply). - Tracking Disclosure
Our bikes may use GPS or electronic tracking devices for security and recovery purposes. - Rider Requirements
The minimum age to ride one of our e-bikes is 12 years. Riders must be at least 150 cm (4 ft 9 in) tall, with a maximum weight of 140 kg and a maximum height of 210 cm (6 ft 7 in). - Riders Under 18
Riders under 18 years must be supervised by a responsible adult who accepts responsibility for the hire. - Optional Damage Insurance
Optional damage insurance, if purchased, covers accidental damage only and does not cover theft, loss or negligent use of equipment.
(3) Cancellation and Amendment Policy:
- Our rides operate in most weather conditions. Waiheke weather can change quickly, so please bring suitable clothing. Weather decisions are normally made on the morning of the ride.
- If conditions are considered unsafe (for example severe storms or high winds), eRide Waiheke may cancel or postpone the ride. In this case we will offer a reschedule, credit or refund.
- If you choose not to ride due to weather conditions, our standard cancellation policy applies.
- We offer a 100% refund of the e-bike hire fee if you cancel at least 48 hours before the scheduled start time. The booking fee is non-refundable. Cancellations must be made via email to [email protected].
- No refunds will be given for no-shows, change of mind, or early returns once the hire has commenced. No refunds will be given for a “non-performing bike” unless you contact us during the ride so we can provide support. Failure to contact us during the ride is not an excuse.
- In the event of illness or injury, bookings may be rescheduled. Please email [email protected] to request the change as soon as you can.
- Some cancellations may incur a $50 NZD administration fee.
- Due to the nature of our tours and rentals and the environment they operate in, we may occasionally cancel or postpone a ride due to severe weather, safety concerns, or circumstances beyond our control. If we cancel for these reasons, you will receive a full refund within 5 calendar days.
(4) RISK DISCLOSURE
By proceeding with the paymnet and eBike Hire, You are agreeing to the following statement and all eRide terms and conditions:
- I understand biking can be dangerous. These risks include, but are not limited to, riding in traffic, navigating around Waiheke Island, adverse weather conditions, uneven surfaces, collisions, physical strain, and other potential hazards. I confirm my physical fitness and have disclosed any relevant injuries or medical conditions.
- I accept full responsibility for my actions and will not hold The Waiheke Bike Shop Ltd T/A eRide Waiheke or associated staff liable for any injury to any person or damage to any property – caused during my use of the equipment.
- I have discussed with The Waiheke Bike Shop Ltd T/A eRide Waiheke staff my intended use and have chosen the most suitable bike for my needs.
- I will also wear appropriate footwear and clothing to prevent injury to myself and/or the equipment.
- I understand that operating the equipment while under the influence of alcohol or drugs or impairment, can affect my riding ability, which can endanger myself and / or others. In such cases, I will NOT ride the equipment. If you need assistance, please call our team for (fees may apply).

- Nothing in these terms limits or excludes any rights you may have under New Zealand law, including the Consumer Guarantees Act 1993, to the extent those rights cannot be excluded.
(5) INTERNATIONAL ONLY:
You should ensure that you have appropriate travel insurance to cover this type of activity.
(6) GROUP BOOKINGS ONLY:
- You acknowledge that you have informed all members of the risk disclosures;
- You will be agreeing to these terms on behalf of all people in your group;
- You will take full responsibility for each bike and person within the group.
- You will ensure that you and each member of your group has adequate insurance, or will purchase this from us, as required.
